Terms and Conditions of Use
1. Introduction and General Provisions
Welcome to the "Studio by Elinoya" website (hereinafter: the "Website"). The Website is owned and operated by "Studio by Elinoya" (hereinafter: "Studio by Elinoya", the "Operator", or the "Business"), located at www.studiobyelinoya.com (hereinafter: the "Website Address"). The Website operates as a virtual store for renting luxury clothing items , scheduling fitting appointments, and related services.

Business Status: The Business operates as an "Exempt Dealer" (Osek Patur). Consequently, prices displayed on the Website do not include VAT, as the Business is exempt from VAT under applicable law.

Acceptance of Terms and Legal Capacity Acceptance: Any use of the Website (including browsing, scheduling appointments, renting, or using any offered services and etc…) constitutes a declaration that you have read these Terms and Conditions, understood them, and agree to be bound by them.

Legal Capacity: The Website is intended for users over the age of 18. Customers under the age of 18 are required to inform their legal guardian and obtain approval prior to performing any actions on the Website.
These Terms are written in the female gender for convenience but apply equally to all genders.
2. Studio Fitting Services

The Website allows for the scheduling of fitting appointments at the brand's physical studio.

Fitting Fee: Scheduling an appointment involves a "Deposit" payment of 70 NIS.

Set-Off: This amount will be deducted (Setted-Off) from the rental cost if a transaction (rental of an item of clothing) is completed during the appointment.

Cancellation or Non-Rental: The fitting fee will not be refunded in the event of a "No-Show" or cancellation made less than 24 hours prior to the scheduled time. Furthermore, if no clothing item is rented, the deposit will not be refunded and will be retained as a "Consultation Fee".
3. Rental Process, Payments, and Availability

Online rentals require full payment in advance and approval from the credit card company.

Pricing: Prices are quoted in New Israeli Shekels (NIS). As an Exempt Dealer, prices do not include VAT.

Availability: Completion of an online order is subject to the availability of the clothing item on the requested date. In case of double booking or unavailability, the Business management will contact the Customer to coordinate a replacement model or provide a full cancellation and refund without charge.

Defects, Limitation of Liability, and Sole Remedy Defects: If a clothing item is unfit for rental due to damage caused by a previous customer or a third-party return delay, management will contact the Customer to arrange a replacement or issue a full refund.

Visual Representation: Website images are for illustrative purposes only. Slight color variations may occur due to screen display differences. Responsibility for size selection lies solely with the Customer.

Limitation of Claims: It is hereby agreed that in the event of cancellation due to unavailability (for any reason), the Customer’s sole and exclusive remedy shall be a full refund of the amount actually paid. The Customer waives any claim, demand, or lawsuit against the Business for indirect damages, including mental anguish, incidental expenses, or any other damage caused by the non-supply of the clothing item.
4. Shipping and Delivery Options

Customers may choose between self-pickup from the Studio at Shlomo Ibn Gabirol 144 St., Tel Aviv-Yafo, or delivery via a courier service.

Liability: clothing items are shipped via an external courier company. The Business shall not be liable for delays caused by Force Majeure, courier company issues, strikes, wars, or circumstances beyond its control, though it will endeavor to resolve any issues.

Delivery Times: Delivery will be coordinated to arrive within 3-7 business days from the booking date. Customers are advised to order in advance to prevent delays.

Returns and Collection Courier Return: It is the Customer's sole responsibility to coordinate the return pickup for the first business day following the event date. The Customer must be available at the provided address and time for handover the clothing item to the courier.

Self-Return and Return Timing: Clothing items may be picked up/returned to the Studio at Shlomo Ibn Gabirol 144 St., Tel Aviv-Yafo. The clothing item must be returned on the first business day following the event, no later than 15:00.

Pick-Up &. Holding Period: The clothing item will be collected approximately two days before the event date. For self-pickup, the clothing item will be held for one day only from the scheduled pickup date. Failure to collect does not constitute grounds for cancellation or refund.

Weekend Events: For events held on Friday or Saturday, the clothing item must be returned on the following Sunday, no later than 15:00.

Late Fees: Late return of the clothing item (whether by self-return or courier handover) will incur a daily late fee of 200 NIS for each day of delay. This amount will be automatically deducted from the security details provided by the Customer without further notice.

Product Integrity: The Customer is strictly prohibited from washing, cleaning, ironing, or attempting to repair the clothing item independently. All maintenance is performed exclusively by the Studio.
5. Product Care, Security Deposit, and Damages Prohibitions

Security Deposit & Tokenization: Upon booking, the Customer grants irrevocable consent to store credit card details in a secure clearing system (Tokenization) as security. These details will be held until the clothing item is returned and inspected.

Authorization to Charge: The Customer grants irrevocable consent to charge the stored credit card for any damages (stains, tears, etc.), missing items, or late returns without prior notice.

Damages Policy: The customer is responsible for returning the clothing item in good condition. If the clothing item is returned with irremovable stains or tears, the security deposit will not be refunded to the customer. Repairable Damage: The Customer will be charged the full cost of professional repair (e.g., loose seams, missing stones). Irreversible Damage: In cases of deep stains, significant tears, loss, or total damage, the Customer will be charged the full retail price of the clothing item as defined by the manufacturer/brand.

Mutual Inspection and Documentation Obligations (Proof of Damage - Customer and Business):
(a) Customer Inspection Upon Receipt: It is the Customer's sole responsibility to inspect the dress immediately upon receipt (whether via courier or self-pickup). In the event that a defect, stain, or discrepancy is discovered, the Customer must clearly and immediately photograph the defect (prior to any use of the dress) and report said issue by uploading the image to the inquiry form located on the Website under the tab: "Cancellations, Changes, and Updates Form". It is hereby agreed that failure to submit an immediate report accompanied by photographic documentation shall constitute confirmation that the dress was received in good and perfect condition. Consequently, no subsequent claims regarding pre-existing defects shall be accepted.
b) Business Documentation Upon Return: It is clarified that upon the return of the dress to the Studio, the Business staff reserves the right to document the unboxing and inspection of the product via photography or video recording. Such documentation shall serve as conclusive and exclusive evidence in the event of any dispute regarding damages, stains, or missing items discovered in the dress following its use.

Condition of the clothing item, cleaning and care: The clothing item is delivered clean. Cleaning is performed exclusively only by the studio. The client is strictly prohibited from washing, cleaning, ironing or making repairs to the clothing item herself. Any care will be performed exclusively by the studio.
6. Cancellation Policy

Cancellations are subject to the Consumer Protection Law. A rental transaction may be cancelled within 14 days of booking, provided that the cancellation is made at least 14 business days prior to the event/rental date.

Cancellation within the 14 Business Day Period (Late Cancellation): It is hereby clarified that in the event of a transaction cancellation made less than 14 business days prior to the Event/Delivery Date (even if 14 days have not yet elapsed since the Order Date), the Customer shall be charged the full transaction amount and shall not be entitled to any refund. This policy applies as the clothing item was reserved exclusively for the Customer, thereby preventing its rental to third parties.

Cancellation Fee: For legal cancellations meeting the above criteria, a cancellation fee of 5% of the transaction value or 100 NIS (whichever is lower) will be deducted.

No Refunds: No refunds or credits will be issued after the clothing item has been dispatched or picked up, regardless of usage.

Sale Items: Cancellation policies for items on sale/discount will follow the specific legal provisions displayed on the sale page.
7. Business Collaborations (B2B)

The Business engages in collaborations with other commercial entities, photographers, and content creators.

Specific Terms: The terms and conditions for any collaboration, loan of items for photography/productions, or commercial rentals shall be agreed upon separately in a written agreement.

Applicability of Standard Terms: Notwithstanding the above, the provisions of these Terms and Conditions regarding "Compensation for Damages" and the "Prohibition of Independent Cleaning" shall apply fully to all business collaborations, unless explicitly agreed otherwise in writing in advance.
8. Intellectual Property and Privacy

Intellectual Property Rights: All content displayed on the Website, including but not limited to images of clothing items, trademarks, photographs, graphic design, and source code, constitutes the exclusive property of "Studio by Elinoya" and the Business management. Any copying, reproduction, or use thereof without prior written permission is strictly prohibited.

Copyright Infringement: As all content constitutes the exclusive property of "Studio by Elinoya", any unauthorized use exposes the user to legal action for infringement of copyrights, designs, and/or trademarks.

Statutory Damages (Compensation without Proof of Damage): Pursuant to Israeli law, a copyright holder is entitled to sue for significant statutory damages (which may amount to tens of thousands of Shekels per infringement) without the burden of proving actual financial damage.

Injunctive Relief: The Business management reserves the right to apply to the competent court for an injunction (restraining order) compelling the infringing party to immediately remove the content from any platform.

Privacy & Mailing: Customer data is used solely for order processing. The site uses Cookies. By registering, you agree to receive updates/promotions. You may unsubscribe at any time via email to studionbyelinoya@gmail.com or via SMS to 054-4364-335, removal taking up to 14 business days.

Security: Credit card clearing is performed by an authorized external provider. The Business does not store full credit card numbers and is not liable for data exposure resulting from unauthorized cyber intrusions.
9. Limitation of Liability and Jurisdiction Liability Cap

The Business total liability towards the Customer for any damage or loss related to the rental shall in no case exceed the actual amount paid by the Customer for that specific transaction.

Jurisdiction: These Terms shall be governed by the laws of the State of Israel. Exclusive jurisdiction for any dispute lies with the courts of Tel Aviv-Yafo.

General Limitation of Liability: The Business management employs its best efforts to provide the clothing items on schedule and in excellent condition. However, the total aggregate liability of the Business towards the Customer for any damage or loss related to the rental shall in no event exceed the actual amount paid by the Customer for that specific transaction.
